What to Do After a Car Accident

First, seek medical attention immediately, even if the collision seems minor.  It is important to get evaluated so that you can be diagnosed and treated for any injuries that you may have suffered.  This will prevent a minor injury from becoming more serious, and may stop the insurance company from arguing that you made your injuries worse by failing to seek treatment.

Second, if you are able to, collect evidence.  This may include paperwork such as a police accident report, insurance and contact information for the other driver,  hospital and ambulance records, and photographs or videos of the scene.   You should also make a list of potential witnesses along with their contact information, including passengers, the other driver, and anyone who might have seen what happened.

Third, write down as much as you can remember about the accident as soon as possible after the crash, while your memory is fresh.  The longer you wait to chronicle the accident, the more likely it is that you may forget critical details.  Include everything that you can think of, such as the weather at the time of the accident, whether there were any obstructions in the road, and other factors.

Fourth — and most importantly — do not speak to the other driver or their insurance adjuster about the accident. Exchange information, and decline to answer further questions. Do not apologize or say anything that could be construed as accepting fault. Your lawyer can then handle communications with the insurance company, working to get you the best possible outcome.
